According to the China Trademark Law, once the trademark owner changes his/its name or address, the trademark modification application shall be filed to re-fresh the official record. The Modification application helps better protect your trademark exclusive right.
If you’ve filed a mark in the name of a company/individual and changed the name after the filing, the new applications which is filed in the new name for a similar or identical mark will be rejected/refused. Because the Trademark Office will think they are two applicants and their similar/identical marks shall not co-exist.
Types of Modification:
- Name change of the applicant/trademark owner
- Address change of the applicant/trademark owner
- Change the representative (refers to Chinese attorneys/agents)
